Terms & conditions
These General Terms & Conditions (hereafter referred to as the GTCs) are a legal agreement between Bulles de Joie hereafter referred to as the “Supplier” and the client regarding any purchased experience. Bulles de Joie’s registration number: 752 676 155 00027. These GTCs apply to any and all experiences offered by Bulles de Joie and mentioned on the website: www.bullesdejoie.net. Bulles de Joie is fully entitled to modify its GTCs at any time and is committed to update the changes on its website.
1. Scope of work
Bulles de Joie offers photography experiences, which are all detailed on the website: www.bullesdejoie.net. By booking a photography experience, the client automatically accepts these GTCs, except where any specific condition is agreed between the Supplier and the client. The GTCs form an indivisible agreement, which the client must fill in, sign and send back by email to the Supplier before the photo session occurs.
2 . Subcontracting
Bulles de Joie may subcontract the performance of the service in whole or in part with prior client’s agreement, unless personal performance is required by the the contract. Any subcontractor so engaged by Bulles de Joie must be of adequate compe tence.
Bulles de Joie must ensure that any tools and materials used for the performance of the service are in conformity with the contract and the applicable statutory rules, and fit to achieve the particular purpose for which they are to be used.
3. Booking a photo session
The client can confirm and book a photo session over the phone (mobile number : +33 6 65 26 10 14) or by email: contact@bullesdejoie.net.
The booking can be confirmed at any time depending on the client and supplier’s availabilities. Last minute bookings can be accepted but have to be discussed and agreed with the photographer at the first place. The reservation is confirmed by the Supplier once a deposit is paid online by credit card or bank transfer to the Supplier via a link sent to the client.
4. The photo session
All information regarding the photo session i.e. meeting point will be sent by the Supplier prior to the session by email. More general information regarding photo sessions can be found here: FAQ. The client can request additional hours at extra charge to be paid on the day by cash according to the photographer’s availability.
5. Late arrival
Clients must arrive on time and respect the agreed schedule.
6. Payment
To proceed to the booking, a 50% deposit shall be paid online by credit card or bank transfer to the Supplier in order to secure such booking. All terms and conditions should be read carefully and signed before making the 50% deposit. The remaining payment shall be made to the photographer on the day of the photo session by cash.
7. Photo delivery
Photos are delivered between 7-15 working days and the client will be notified once ready.
Photos that are being delivered are going through a light post-production process that improves their color and adjust exposure and contrast for the best result. No modification of the face nor the body will be made.
The number of photos chosen depends on the selected package. Raw format photos are never delivered to the client.
Bulles de Joie or Subcontractor will not be responsible for any loss or damage of the digital images. Request for duplicate formats will be charged to the client. The photos taken as well as the post-processing are part of the photographer’s style and artistic choice that will reflect his online portfolio that the client would have seen before. Any new photo edits proposed by the client and agreed by the photographer will be charged additionally to the client.
8. Cancellation
Once the booking of a photo session is made, it becomes effective. If the photoshoot has to be cancelled, 30% of the deposit will be kept if it happen s more than one week previous to the session and 60% if the cancell ation happens less than one week earlier.
When there is a no show by the client, the deposit will not be reimbursed.
9. Force majeure & sickness
In case of force majeure or sickness prior to the photo session, the Supplier may cancel the photo session and the deposit will be reimboursed. The cancellation cannot involve responsibility of the Supplier nor result in lawsuits. The supplier commits to use best efforts to propose other dates to the client or to another reliable photographer to cover the photo session. However, the photographer cannot be held responsible if the client were not happy with the style or quality of the photos delivered.
10. Technical problem or accident
If a technical problem or accident (case of force majeure) affects the Supplier or Subcontractor during the photo session that will prevent the Supplier to perform its job, the amount of the deposit paid to secure the booking will be refunded to the client and cannot result in lawsuits. In case of technical computer issue, the delivery of the photos can be delayed and the client will be notified accordingly.
11. Responsability
Bulles de Joie or Subcontractor cannot be held responsible for any loss, damaged or stolen personal belongings of the client that may occur during the photo session. The client and any accompanying persons there is responsible for keeping his belongings.
12. Intellectual property
The content of the website www.bullesdejoie.net is the property of Bulles de Joie and is protected by French and international laws regarding intellectual property. The whole content of the internet website and editorial, graphics, logo, brand and photos belong to Bulles de Joie and any copy, translation of any of the site content is totally forbidden. Copyright and related rights protect the use of photos during a session. Copyright and intellectual property rights of the 11 March 1957 law protect French Photographers.
The delivery of the digital files assigns the right to digital reproduction on all support and format only within the private and family area. The client shall respect the moral rights over the photographer’s work. Bulles de Joie has the right to use the photos taken during a photo session in order to promote its activities (unless otherwise expressly notified by the client in writing prior to the photo session).
The client authorizes Bulles de Joie or Subcontractor to use freely the pictures in which the client appears without asking any income or copyright for the following usage:
* Portfolio
* Website
* Social media
* Marketing & Communication support (prints, flyers, books, name cards, etc.)
The photos taken as well as the comments linked to images should not strike a blow to the client’s image or reputation.
The client should support the Supplier in case:
* A third party uses the photos in an abusive way
* Ask permission for any commercial use
The client understands that when publishing photos on websites, i.e. personal website, Facebook, Instagram, etc., she/he will credit the photographs to “Bulles de Joie” and not edit the photos in any way.
13. Archive of digital files
Bulles de Joie or the Subcontractor commits to keep the digital files at least six months from the date of the photo session (except if an accident occurs that cannot involve the supplier’s responsibility: fire, flooding, damaged hard drive, etc.… (force majeure). After this period of time, the supplier may destroy the files any time.
14. Modifications of terms and conditions
Bulles de Joie is entitled to modify its GTCs at any time and is committed to update the changes on its website. The modifications will apply to any booking made after the modifications’ date.
15. Clients private data
The supplier commits to preserve its clients private life and its visitors’ on www.bullesdejoie.net.
16. Applicable law
All photo sessions’ assignments are subject to French law. For any dispute regarding this GTCs, only French courts shall be the competent authorities.
